These Terms of Service apply when you access or use The Smuggling Duckling website, place an order, or purchase products from us. By using the site or placing an order, you agree to these terms to the extent permitted by applicable law.

Store and product information

We aim to keep product descriptions, specifications, images, pricing and availability accurate. Minor presentation differences can occur across screens and production batches. If we identify a material pricing, specification or listing error before dispatch, we may contact you to confirm how you wish to proceed or cancel and refund the affected order where appropriate.

Professional equipment and suitability

Some products sold by The Smuggling Duckling are professional or trade equipment. You are responsible for assessing whether a product is suitable for your intended application, operating it safely, following manufacturer instructions and complying with any laws, workplace requirements or industry standards that apply to your use.

Where a product description refers to a 512Hz transmitter, compatible locating equipment is required to locate the transmitter from above ground and is not included unless the product listing expressly says otherwise.

Orders and payment

Submitting an order is an offer to purchase. Orders are subject to successful payment, availability and our ability to supply the item. We may refuse or cancel an order before dispatch where reasonably necessary, including for payment failure, suspected fraud, a material listing error or inability to supply. If we cancel an order after payment has been captured, we will arrange an appropriate refund.

Pricing

Prices are displayed in the currency shown on the site or at checkout. Shipping charges, taxes, duties or other destination-specific charges may apply and will be handled as described at checkout and in our Shipping Policy.

Shipping

We ship throughout Australia and to selected international destinations. Shipping availability, rates and delivery services depend on the destination and are confirmed at checkout. Delivery estimates are not guarantees and may be affected by carriers, customs, weather, remote locations and other events outside our reasonable control.

International orders

International orders may be subject to import duties, taxes, customs charges or local fees imposed by the destination country. Unless checkout expressly states otherwise, these charges are the recipient's responsibility.

Returns, faults and consumer rights

Returns and refunds are handled under our Refund & Returns Policy and applicable consumer law. Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.

No guaranteed commercial outcome

Any examples of possible job revenue, payback, savings, productivity or commercial use are illustrative only. Actual pricing, demand, job volume, operating costs and profitability vary. We do not guarantee that purchasing a product will produce a particular financial or business outcome.

Website use and intellectual property

Unless otherwise stated, the website design, brand elements, written content and original creative material are owned by or licensed to The Smuggling Duckling. You may use the site for personal or legitimate business purchasing purposes, but you must not copy, republish, scrape, misuse or commercially exploit our content in a way that infringes applicable rights.

Third-party services and links

Our site may use or link to third-party services, including Shopify, payment providers, carriers and external websites. Their services may be subject to separate terms and privacy practices. We are not responsible for third-party content or services except to the extent required by law.

Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website or products where that liability can lawfully be excluded. Nothing in these terms limits liability or consumer rights that cannot legally be limited or excluded.

We may update these terms from time to time. The version published on the website at the time of your transaction will apply to that transaction except where applicable law requires otherwise.
